Terms of Service

1. Agreement to These Terms

These Terms of Service (“Terms”) govern your access to and use of the mobile games and related services (collectively, the “Services”) provided by Mare Games OÜ (“Mare Games”, “we”, “our”, or “us”), including our published games Gravital and QuizBattle. By downloading, installing, accessing, or using any of our Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 13 years old to use the Services. If you are under the age of majority in your country, you may use the Services only with the consent of a parent or legal guardian, who is responsible for your actions.

3. Accounts and Authentication

QuizBattle requires you to sign in with Google or, on iOS, with Apple. You agree to provide accurate information and to keep your account secure, and you are responsible for all activity that occurs under your account. Gravital requires no account.

4. License and Acceptable Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial entertainment purposes, subject to these Terms.

You agree not to:

  • Use the Services for any illegal or unauthorized purpose.
  • Cheat, exploit bugs, or use automated systems to access or play the games.
  • Reverse engineer, modify, or create derivative works of the Services.
  • Harass, threaten, or harm other players or post unlawful content.
  • Interfere with the normal operation or security of the Services.

5. Intellectual Property

The Services, including all games, artwork, characters, music, software, and trademarks, are owned by Mare Games or its licensors and are protected by intellectual property laws. Nothing in these Terms transfers any ownership to you.

6. Virtual Items and In-App Purchases

Our games sell virtual currency, virtual items, and other digital content (“Virtual Items”), such as gem packs, jokers, bundles, and battle passes in QuizBattle. Virtual Items have no real-world monetary value, are licensed to you and not sold, and cannot be exchanged for cash or transferred to another person.

Purchases are processed by the Apple App Store or Google Play and are subject to their terms. Refund requests are handled through the store where you made the purchase. Except where required by law or by the store’s own policy, purchases are final. You are responsible for any charges incurred on your account, including by someone who has access to your device. We may adjust or remove Virtual Items that were obtained through fraud, abuse, or technical error.

7. Advertising

The games display third-party advertisements. Whether ads are personalized to you follows the choice you make in the in-game privacy banner, as described in our Privacy Policy.

8. Live Services and Changes to the Games

Our games are live services. Content, features, Virtual Item catalogs, prices, seasons, leaderboards, and events may change, rotate, or end over time, and we may add, modify, or retire features. We may also take the Services offline temporarily for maintenance. We are not obliged to keep any particular game, feature, or Virtual Item available indefinitely.

9. User Content

Where the Services allow you to submit content, such as usernames, avatars, or feedback, you retain ownership of your content but grant us a worldwide, royalty-free license to host, use, reproduce, and display it solely to operate and improve the Services. We may require you to change, or we may remove, content that violates these Terms.

10. Third-Party Services

The Services rely on third-party services such as sign-in providers, analytics and crash reporting, advertising, and the app stores’ billing systems. Those services are subject to their own terms and policies, and our Privacy Policy describes what data they receive.

11. Termination

We may suspend or terminate your access at any time if we believe you have violated these Terms, or to protect the integrity, security, or availability of the Services. You may stop using the Services at any time and request account deletion as described on our Data Deletion page.

12. Disclaimers

The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, non-infringement, and uninterrupted availability.

13. Limitation of Liability

To the fullest extent permitted by law, Mare Games shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from or related to your use of the Services. Nothing in these Terms limits any liability that cannot be limited under applicable law.

14. Indemnification

You agree to indemnify and hold harmless Mare Games from any claims, damages, liabilities, and expenses arising from your misuse of the Services, your content, or your violation of these Terms.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of Estonia, without regard to conflict of law rules. Any disputes shall be subject to the exclusive jurisdiction of Estonian courts, unless mandatory consumer laws in your country provide otherwise.

16. Changes to These Terms

We may update these Terms from time to time. Changes are effective when posted on this page. Your continued use of the Services after changes are posted means you accept the updated Terms.
